1. Introduction
By accessing or using the services of East Coast Aquatics LLC, you agree to abide by these Terms & Conditions. These terms govern your use of the website and all services provided.
2. Service Availability & Delays
We strive to provide timely and efficient services. However, certain factors such as weather conditions, equipment issues, or other unforeseen circumstances may cause delays. In such cases, we will notify customers as soon as possible and reschedule services accordingly.
3. Force Majeure
East Coast Aquatics LLC will not be held liable for any failure to perform its obligations due to events beyond its control, including but not limited to natural disasters, fires, strikes, or government restrictions. These events are considered Force Majeure, and we will work to resolve the situation as quickly as possible.
4. Service Cancellation & Refund Policy
One-Time Service: To cancel any one-time service, customers must notify us at least 48 hours in advance. A 25% penalty will apply for cancellations within 48 hours.
Contract Cancellation: Customers wishing to exit a contract within the first month will not incur a penalty but will remain responsible for the full month’s payment or the cost of an opening service.
Post-Booking Cancellation: Customers may cancel up to 72 hours after booking or signing without penalty, provided the cancellation is not within 24 hours before the scheduled service.
Refunds: Full refunds will be issued via the original payment method.
5. Liability
East Coast Aquatics LLC is committed to delivering high-quality service. While our liability is officially limited to the minimum required by applicable law, we proudly stand behind the work we perform. If an issue arises that is directly caused by our service, we will take appropriate steps to correct it. However, we are not responsible for pre-existing conditions, aging equipment, environmental factors, or any issues not directly caused by our actions. Customers are responsible for the overall condition and maintenance of their pool and related systems.
6. Dispute Resolution
In the event of a dispute, East Coast Aquatics LLC encourages customers to first seek resolution through mediation. If mediation fails, we may proceed to arbitration, which is binding. If a resolution cannot be reached through these methods, the matter may be taken to small claims court.
7. User Information Policy
East Coast Aquatics LLC respects your privacy. We collect only the information necessary to provide services, including your name, address, email, and payment details. This information is used solely for business purposes and is not shared with third parties, except as required to process payments or comply with legal obligations. By using our services, you consent to this use of your information.
8. Insurance & Service Assurance
East Coast Aquatics LLC is a fully insured business. We are committed to providing high-quality service and standing by the work we perform. If any service-related issues arise that are determined to be our responsibility, we will take appropriate action to correct them.
9. Governing Law
These Terms & Conditions are governed by the laws of the State of New Jersey. Any legal proceedings related to these terms will be handled in New Jersey.
10. Amendments
East Coast Aquatics LLC reserves the right to update or modify these Terms & Conditions at any time. Any changes will be posted on this page, and your continued use of the services constitutes acceptance of the updated terms.
11. Promotions & Service Descriptions
Descriptions of promotional offers, branded services, and product inclusions—such as “free chlorine” or maintenance plan features—will be clearly defined on our website, invoices, or service agreements as applicable. Customers are encouraged to review the specific terms of any offer or product before purchase or sign-up. East Coast Aquatics LLC reserves the right to clarify or update promotional terms as needed.
12. Payment Terms
Payment is due upon receipt of invoice unless otherwise agreed in writing. For seasonal contracts, payment may be made in full upfront or on a recurring schedule as outlined in the agreement. We accept major credit cards and other electronic payment methods. Failure to pay on time may result in service delays, cancellation of scheduled services, or additional fees. East Coast Aquatics LLC reserves the right to pursue outstanding balances through collections or legal means, if necessary.
